Legal regulation of national minorities’ status.

 

The regional regulations state: “ The activity of regional state authority and local government bodies is aimed at ensuring the adequate life conditions, ecological-friendly environment, development of economy, culture, social sphere, taking into account the peculiarities of the region, its traditions, mode of life, ethnic structure, spheres of population’s activity.” Besides, the regional state authorities in common with the local government bodies and public societies take measures to develop cultural, language traditions of people, belonging to different nationalities, religions, modes of lives in cities, towns and other populated areas. (Art.3, p.1, 3 of Saratov region Regulations (the Principal Law) of 5th April 1995 in Law wording of 09.12.2000 N73-RLA).

The Regulations provide the personal rights authorized agent institution (it was set up in 1998). The regional personal rights authorized agent guarantees the protection of personal and citizens’ rights and liberties, the protection of national minorities’ rights, their observation by state authority and local government bodies, as well as their officials (Art. 21 p. 1 of the Regulations). In 1998 the appropriate law on personal rights authorized agent, which regulates the authorized agent competence, the procedure of his appointment and dismissal, was approved in Saratov region (Saratov region Law of 12 October 1998 N 50- RLA).

 There are not a great number of the legislative acts, regulating the national minorities’ rights, and all of them repeat the appropriate federal law rules. (On youth policy in Saratov region of 24 October 2001 N 50- RLA, On educational policy of 15 June 1999 N 30-RLA, On the state registering procedure of the municipal formations regulations in Saratov region of 21 June 1996 (in Saratov region Law wording of 06.05.1997 N 24-RLA), On administrative – territorial formation and municipal formation areas of 3 April 2000 N 21-RLA, legislation on state and municipal service, elections and referenda conduction, etc.).

The principal documentation, regulating the regional national policy and national minorities’ rights, is Conception of national policy in Saratov region and “ Social and national-cultural development of Saratov region peoples for 1998-2001” Program, adopted by the regional Duma Resolutions.

Other programs, regulating national minorities’ rights in the specific areas, are considered to be by-law: The regional program of apprehensive education development in Saratov region within 1996-1998, which was approved by Saratov Regional Duma Resolution N 28-406 of 24 May 1996. In addition, it is the cultural development conception in Saratov region within 2001-2005, Appendix to Saratov region Government Resolution of 27 November 2001 N 123-R.

The concrete measures in national policy sphere are regulated by the Government resolutions: e.g. establishing “The center of Saratov region peoples’ friendship” (the Government resolution of 19 October N 351- G ), providing the premises for Saratov Judaic community “Khabat-Lubavich” (of 3 October 2000 N 335-G), establishing Russian – German House (of 19 March 1998 N 266- inst.), conducting festive occasions and days devoted to national cultures (of 26 May 1999 N 112-G, of 24 May 2000 N 186-G and of 1 March 2000 N 88-G ), conducting conferences (of 15 March 2001 N 70-G ).

The regulations on the governmental and Governor staff structural subdivisions, responsible for national policy and consultative bodies are regarded as by-law acts (s. the appropriate units).

It is evidently that unlike the middle of the 90th, the normative legal acts, concerning the national policy, being adopted by both legislative and executive authorities, lately the executive authority mainly adopts such documents.
